Il y des directives en Suisse concernant les conflits d'intérêts?
Oui, par l'Académie Suisse des Sciences Médicales (ASSM) et FMH.

C’est en 2002 que l’ASSM a publié pour la première fois des «Recommandations sur la collaboration corps médical – industrie»; comme elle l’avait précisé alors, ces recommandations ont été révisées et, au besoin, adaptées en été 2004. Par ailleurs, il ne s’agit plus de recommandations, mais de «directives», incluant également les «Directives de la FMH pour la reconnaissance de sessions de formation continue dans le cadre de la RFC». Leur but n’est pas d’interdire, mais de contribuer à promouvoir l’objectivité, la qualité et la transparence, à éviter les dépendances et à gérer en connaissance de cause les conflits d’intérêts.

8. Lors de la publication et de la présentation des résultats d’un essai, le financement de celui-ci doit être divulgué
Les publications relatives aux résultats d’essais doivent comporter une remarque ou une annotation indiquant clairement au lecteur qui a financé
l’essai en tant que promoteur. Lors de la présentation des résultats d’essais dans le cadre de conférences, de congrès ou d’autres manifestations similaires, cette information doit être mise clairement en évidence, tout comme les éventuels mandats des auteurs pouvant susciter des conflits d’intérêts.

9. L’interprétation des résultats d’un essai doit être indépendante des intérêts du promoteur
Il convient d’éviter tout conflit d’intérêts lors de l’interprétation des résultats d’un essai dans des publications ou lors de présentations. L’investigateur responsable doit donc veiller tout particulièrement à ce que
– les effets recherchés ou indésirables observés lors de l’essai d’un produit ou d’un procédé soient discutés de manière factuelle et critique;
– le rapport coût-bénéfice du produit ou du procédé faisant l’objet de l’essai soit présenté de la façon la plus objective possible.

10. Les chercheurs ne collaborent pas aux activités de marketing en faveur de produits ayant fait l’objet d’essais auxquels ils ont participé
L’investigateur responsable d’un essai et ses collaborateurs ne doivent pas mettre en jeu leur crédibilité en participant à des opérations de
marketing pour le produit ou le procédé faisant l’objet de l’essai.

7. Les intervenants et les organisateurs font connaître leurs éventuels intérêts commerciaux personnels ou institutionnels, liens financiers avec le promoteur ou mandats de consultance octroyés par le promoteur, ainsi que les éventuelles contributions du promoteur en faveur de leurs travaux de recherche Les honoraires des intervenants doivent être raisonnables.
Tous les promoteurs sont mentionnés dans le programme et la documentation de la session de formation continue. Les intervenants font connaître, de manière appropriée, leurs intérêts divergents à l’organisateur, à la société de discipline médicale et, avant le début de leur présentation, aux participants.

Sans contrat ou contrepartie adéquate, les médecins cliniciens, praticiens et chercheurs n’acceptent, de la part de l’industrie, aucun avantage personnel en espèces ou en nature dépassant les limites de petits gestes de gratitude financièrement insignifiants

C'est directives sont reprises par la FMH et a cause de ça obligatoire pour chaque médecin.

La raison : Novartis a utilisé le valeur impôt et ne pas avec le valeur marché.

Biedermann [Anm simplex: Direktor der Anlagestiftung Ethos] kritisierte unter anderem, dass Novartis die Entschädigung seines Top-Managements statt zum Marktwert zum Steuerwert ausweist. Konzernchef Daniel Vasella hätte so 2009 statt der im Geschäftsbericht angegebenen 20,5 Mio. Fr. rund 42 Mio. Fr. verdient und die höchste Entschädigung unter den zwölf grössten Pharmaunternehmen der Welt erhalten.

Ces buts sont similaires mais ils ne sont pas 100% identiques. Chaque groupe a son rôle.
